Implementation rules of Guangdong Provincial Department of Housing and Urban-Rural Development on Safety Management Measures for Relatively Dangerous Partial Projects

Article 1 In order to strengthen the safety management of dangerous partial and Specific projects, prevent and curb the occurrence of construction production safety accidents, these implementation rules are formulated according to the Safety Management Measures of Dangerous Partial and Specific Projects (Construction Quality [2009] No. 87) of the Ministry of Housing and Urban-Rural Development and in combination with the actual conditions of our province.

Article 2 These Rules shall apply to the safety administration of new construction, reconstruction and expansion projects of house construction and municipal infrastructure projects (hereinafter referred to as "construction projects") within the administrative areas of this province, as well as the partial and partial projects with high risks in renovation and demolition projects.

Article 3 The term "partial and specific projects with high risks" as mentioned in these Rules refers to the partial and specific projects existing in the course of construction that may cause death or injury to workers or cause major adverse social effects.

The special construction plan for safety of section and section projects with high risk (hereinafter referred to as the "special plan") refers to the safety technical measures document independently prepared by the construction enterprise for section and section projects with high risk based on the preparation of construction organization (general) design.

For more dangerous partial and partial projects and the scope of more dangerous partial and partial projects exceeding a certain scale, please refer to Safety Management Measures for More Dangerous Partial and Partial Projects of the Ministry of Housing and Urban-Rural Development (Construction Quality (2009) No. 87).

Article 4 Construction units shall, when going through the procedures for supervising the safety of construction projects, provide a list of partial and sub-item projects with high risk and safety management measures. The construction and supervision enterprises shall establish safety management systems for partial and itemized projects with high risks.

Article 5 For general contracting construction projects, special plans shall be prepared by the general contracting enterprises. Such as construction lifting machinery installation and disassembly, deep foundation pit, attached lifting scaffold, building curtain wall installation, steel structure (network frame, cable membrane structure) installation, blasting and demolition, prestress, underground digging, pipe jacking, underwater work and other professional projects to subcontract, the special scheme can be prepared by professional contractors.

Article 6 The compilation of a special program shall include the following contents:

(1) General survey, construction plan layout, construction requirements and technical guarantee conditions of the partial and specific projects with relatively high risks.

(2) Relevant laws, regulations, normative documents, technical specifications, standards and drawings (national standard atlas), construction organization design, etc., on which the compilation is based.

(3) construction schedule, material and equipment plan.

(4) Technical parameters, technological process, construction method, inspection and acceptance, etc.

(5) calculation books, relevant construction drawings and detailed drawings of nodes.

(6) Organizational structure of project safety management (including name, position, job responsibility and contact number of relevant personnel), construction safety technical measures, emergency rescue plan, monitoring and monitoring measures, etc.

(7) The name list of the personnel involved in the preparation of plans and examination, as well as their educational background, majors, titles and positions.

(8) The name list of full-time production safety management personnel and special operation personnel related to the project Department, and their safety examination certificates and special operation qualification certificates.

Article 7 the specific proposal should be by construction enterprise technical department organization this unit construction technology, safety, quality and other departments of audit professional and technical personnel, approved by the audit, signed by the construction enterprise technical director, supervision of the newspaper after build official seal of the unit as a legal person enterprise, signed by the project general supervision engineer audit and qualification registered chop.

In case of general contracting for construction, the special scheme shall be signed by the technical director of the general contracting enterprise and the technical director of the relevant specialized contracting enterprise and affixed with the official seal of the legal person of the unit.

Article 8 The construction enterprise shall organize and hold expert discussion meetings for the special scheme of a partial and sub-item project exceeding a certain scale with high risk. Where general contracting for construction is carried out, the general contracting enterprise for construction shall organize and hold expert discussion meetings.

The following persons shall participate in the expert discussion meeting:

(1) Members of the expert group;

(2) the person in charge of the project or the person in charge of technology of the construction unit;

(3) Chief project supervision engineer and related personnel of the supervision enterprise;

(4) the persons in charge of the administrative organ of production safety and the administrative organ of engineering technology of the undertaking enterprise, the persons in charge of the projects, the persons in charge of the projects, the persons in charge of the projects, the persons in charge of the special schemes, and the full-time persons in charge of the projects of production safety.

If the survey and design is involved, the project technical person in charge and relevant personnel of the survey and design unit may be required to attend.

Article 9 An expert group shall be composed of five or more experts who shall meet the following two basic requirements:

(1) More than 15 years of professional work experience or rich related professional experience;

(2) Having a senior professional title in a relevant field.

No one participating in the project may participate in the expert discussion meeting as an expert.

Article 10 Main contents of expert argumentation:

(1) Whether the content of the special plan is complete and feasible;

(2) whether the calculation and checking basis of the special scheme meet the relevant technical specifications and standards;

(3) whether the basic conditions of safe construction meet the actual situation on the site;

(iv) Whether the relevant construction drawings meet the requirements of construction and acceptance.

After the demonstration of the special scheme, the expert group shall submit the demonstration report, put forward clear opinions on the contents of the demonstration, sign on the demonstration report, and attach the relevant information of the experts (unit, educational background, major, professional title, position, etc.). The report serves as a guide for the revision and improvement of special programs.

The conclusion of the demonstration report should be divided into three types: passed, revised and not passed. If the conclusion of the report is approved after modification, the modification suggestion shall be clear and operable, and the construction enterprise shall modify the proposal according to the suggestion of the special proposal; If the conclusion of the report is not approved, the construction enterprise shall reformulate the plan and organize experts to demonstrate again.

Article 12 When a special scheme is demonstrated, experts shall have the right to refer to project-related technical data and put forward independent argumentation opinions according to the needs of argumentation, without interference from any unit or individual.

Experts shall abide by the relevant management system of expert argumentation, and conduct argumentation objectively, scientifically and honestly. It shall keep confidential the trade secrets it knows in the course of argument.if the construction enterprise deems it necessary, it may also sign an agreement with the experts on keeping trade secrets.

Article 13 The construction enterprise that organizes expert demonstration shall, before the demonstration meeting is held, randomly select 5 or more experts who meet relevant professional requirements from the expert bank at the location of the project to form an expert group. If the local experts cannot meet the needs of expert argumentation, they may be drawn from the expert database of other regions in the province.

Article 14 The construction enterprise that organizes the demonstration by experts shall send the special plan to the demonstration experts 3 days before the demonstration meeting is held. Experts should visit the construction site before the demonstration meeting, understand the actual situation of the construction site, and preexamine the scheme.

Article 15 Enterprises undertaking construction shall organize construction in strict accordance with the special scheme and shall not modify or adjust the special scheme without authorization.

If modification is really necessary due to changes in design, structure, external environment and other factors, the revised special plan shall be re-examined. For a special scheme of a large and dangerous partial project exceeding a certain scale, the construction enterprise shall reorganize experts to conduct demonstration.

Article 16 A partial and specific project with high risk shall, in accordance with relevant regulations, be publicized at an obvious location on the construction site, including the name, location, construction period, the person in charge of construction, the person in charge of safety control, the person in charge of quality control, and the telephone number for complaints and reports.

Article 17 Prior to the implementation of a special plan, the programmer or the project technical leader shall disclose the safety technology to the relevant responsible person, full-time safety officer and other site management personnel and operation personnel of the project department.

Article 18 Enterprises undertaking construction shall designate special personnel to conduct on-site supervision over the implementation of special plans and conduct monitoring according to regulations. If it is found that the construction is not carried out in accordance with the special scheme, it shall demand immediate rectification; If an emergency is found that endangers personal safety, operators shall be organized to evacuate the dangerous area.

The technical person-in-charge of the construction enterprise or the technical person-in-charge of its branch shall regularly inspect the implementation of the special plan, make inspection records, put forward rectification suggestions for existing problems, and set up inspection files.

Article 19 For the partial and itemized projects with high risks that need to be checked and accepted according to regulations, the construction enterprise or supervision enterprise shall organize the project person-in-charge, the special scheme developer, the project technical person-in-charge, the chief supervision engineer, professional supervision engineer and other relevant personnel to carry out the check and acceptance. Those qualified shall enter the next process only after being signed by the technical director and the chief supervision engineer of the project.

Article 20 The supervision enterprises shall include the partial and sub-item projects with high risk into the supervision plan and detailed rules for the implementation of supervision, and formulate the work procedures, methods and measures of safety supervision in light of the characteristics of the projects, surrounding environment and construction technology.

Article 21 Supervision enterprises shall carry out on-site supervision over the implementation of special plans. If the project is not implemented in accordance with the special plan, the construction unit shall be required to make rectification; if the construction enterprise refuses to make rectification, it shall promptly report to the construction unit; The construction unit shall, upon receipt of the report from the supervision enterprise, immediately order the enterprise to stop construction for rectification. If the construction enterprise still does not stop work for rectification, the construction unit shall timely report to the administrative department of housing and urban and rural construction or the construction safety supervision agency.

Article 22 The provincial administrative competent department of housing and urban and rural construction shall be responsible for formulating the classification standards of the expert bank, the examination methods and management systems of the expert qualification. The administrative departments in charge of urban and rural construction of listed housing at the local level shall, in the light of the actual local conditions, establish expert banks according to their professional categories and regularly update the list of experts in the expert banks.

The list of experts shall be published to the public.

Article 23 The administrative departments in charge of urban and rural housing construction at all levels and their construction safety supervision organs shall strengthen the supervision and inspection of the compilation, examination and approval, expert argumentation and implementation of special schemes for sub-project projects with high risks.

Article 24 The construction unit fails to provide the list of partial and itemized projects with high risk and safety management measures as required, or fails to order the construction enterprise that fails to implement the special plan to stop work and make rectification, or fails to report to the administrative department of housing and urban and rural construction on the construction enterprise that refuses to stop work and make rectification; Enterprises undertaking construction fail to draw up and implement special plans in accordance with regulations; If the supervision enterprise fails to examine and verify the special scheme or fails to supervise the partial and itemized projects with high risk, the administrative department of housing and urban and rural construction shall punish it according to relevant laws and regulations.

Article 25 The technical person in charge of a construction enterprise shall carefully examine and verify the special scheme of a partial and specific project with high risk. For a partial and specific project with high risk, the construction enterprise shall, before the construction operation of such partial and specific project, In the form of documents, the name, technical title, signature and a copy of the appointment document of the current technical person in charge shall be provided to the administrative department in charge of housing and urban and rural construction in the place where the project is located or its construction safety supervision agency.

In the process of project construction, if the construction enterprise changes the technical person in charge, it shall, within 15 working days after the completion of the relevant change procedures, provide the above relevant information of the technical person in charge after the change to the local administrative department of housing and urban construction or its construction safety supervision agency.

Article 26 The present Detailed Rules shall go into effect as of the date of promulgation.
