Article 2 The present Measures shall apply to the establishment of administrative organs of production safety and the allocation of full-time administrative personnel of production safety in construction enterprises engaged in civil engineering, construction engineering, installation engineering of lines and pipelines and equipment and the activities of new construction, reconstruction, expansion and demolition of decoration engineering.

Article 3 The administrative organ of production safety mentioned in these Measures refers to the independent functional department set up by construction enterprises to be responsible for the administration of production safety.

Article 4 The term "full-time administrative personnel of production safety" as mentioned in these Measures refers to the full-time personnel who have obtained the certificate of examination of production safety after passing the examination of production safety by the competent department of construction or other relevant departments and are engaged in the administration of production safety in construction enterprises and their projects.

Article 5 Construction enterprises shall set up administrative organs for safe production according to law, and carry out the administration of safe production of their own enterprises under the leadership of the main responsible persons of the enterprises.

Article 6 The administrative organs of safe production of construction enterprises shall have the following responsibilities:

(1) publicize and implement the relevant laws, regulations and standards of the State concerning production safety;

(2) to formulate and timely update the management system of production safety and supervise its implementation;

(3) to organize or participate in the preparation and exercise of emergency rescue preplans for production safety accidents;

(4) Organize and carry out safety education and training and exchanges;

(5) Coordinate and assign full-time project production safety administrative personnel;

(6) to formulate plans for the inspection of production safety of enterprises and organize their implementation;

(7) to supervise the use of safety production expenses for projects under construction;

(8) Participate in the expert discussion meeting of safety special construction scheme of projects with high risk;

(9) Reporting on the investigation and punishment of violations of rules and regulations for projects under construction;

(10) To organize and carry out the work of evaluation and commendation on production safety;

(11) To establish archives for the administration of safety in production of projects under construction;

(12) To examine and evaluate the performance of safety production of the subcontractor and the management of safety production of the project;

To participate in the investigation and handling of production safety accidents;

(14) other duties and responsibilities of the administration of production safety specified by the enterprise.

Article 7 Full-time administrative personnel of production safety of construction enterprises shall have the following duties in the process of site inspection:

(1) to consult the relevant materials of production safety of the projects under construction and verify the relevant information;

(2) to inspect the implementation of special safety construction plans for projects with high risks;

(3) To supervise the performance of responsibilities of full-time project safety administration personnel;

(4) To supervise the allocation and use of safety protective equipment for workers;

(5) It shall have the right to correct on the spot any violation of rules and regulations or hidden dangers of safety discovered;

(6) To have the right to make a decision on the spot to seal up the facilities, equipment and apparatuse that do not meet the conditions for safe production;

(7) It shall have the right to report major hidden safety hazards on the construction site beyond its level or directly to the competent construction department.

(8) Other duties and responsibilities of the administration of production safety specified by the enterprise.

Article 8 The full-time personnel of the administrative organs of production safety of construction enterprises shall meet the following requirements, and shall be increased according to the scale of operation, equipment management and production needs of the enterprises:

(1) Enterprises with general construction contracting qualification sequence: no less than 6 persons with special qualification; At least 4 persons with first-level qualifications; There are at least 3 employees in enterprises with grade II and below qualifications.

(2) Enterprises with professional construction contracting qualification sequence: no less than 3 persons with first-class qualification; No less than 2 employees from enterprises with grade II or below qualifications.

(3) Enterprises with construction labor subcontracting qualification sequence: not less than 2 persons.

(4) Large branches (hereinafter referred to as branches) of construction enterprises, such as branch companies and regional companies, shall be equipped with no less than 2 full-time production safety management personnel according to the actual production conditions.

Article 9 Construction enterprises shall implement the system of appointing full-time administrative personnel of production safety for construction projects. Full-time personnel in charge of the administration of production safety of construction projects shall regularly report the situation of the administration of production safety of the projects to the administrative organ of production safety of the enterprises.

Article 10 Construction enterprises shall set up leading groups for safe production in construction projects. Where construction projects are subject to general contracting, the leading group of production safety shall be composed of the project managers, technical leaders and full-time administrative personnel of production safety of the general contracting enterprises, specialized contracting enterprises and labor subcontracting enterprises.

Article 11 The main responsibilities of the leading group of production safety are as follows:

(1) to implement the relevant state laws, regulations and standards on production safety;

(2) Organize the formulation of project safety production management system and supervise its implementation;

(3) to formulate emergency rescue plans for production safety accidents of the project and organize drills;

(4) Ensure the effective use of project safety production expenses;

(5) to organize the formulation of special safety construction plans for projects with high risks;

(vi) Carry out project safety education and training;

(7) Organize the implementation of project safety inspection and hidden trouble investigation;

(8) To establish the archives of project safety production management;

(9) timely and truthfully report production safety accidents.

Article 12 Full-time project production safety management personnel shall have the following main responsibilities:

(1) To be responsible for the daily inspection of safety production on the construction site and keep inspection records;

(2) On-site supervision of the implementation of special safety construction plans for projects with high risks;

(3) to have the right to correct or investigate and punish violations of rules and regulations by workers;

(4) To have the right to order immediate rectification of hidden safety hazards on the construction site;

(5) it shall have the right to report to the administrative department of production safety of the enterprise any major hidden danger discovered;

(6) to report production safety accidents according to law.

Article 13 The full-time personnel in charge of project production safety assigned by the general contracting units shall meet the following requirements:

(1) Construction projects and decoration projects shall be equipped according to the floor area:

1. Not less than 1 person for a project of less than 10,000 square meters;

2, 10,000 ~ 50,000 square meters of the project not less than 2 people;

There are not less than 3 people in the project of 30,000 square meters and above, and full-time safety production management personnel shall be provided according to the specialty.

(2) Civil works, lines, pipelines and equipment installation works shall be provided according to the contract price:

1. No less than 1 person for a project of less than 50 million yuan;

2, 50 million to 100 million yuan project not less than 2 people;

3, 100 million yuan or more of the project not less than 3 people, and professional equipped with full-time safety production management personnel.

Article 14 The subcontractor shall appoint full-time production safety management personnel for the project to meet the following requirements:

(1) The specialized contractor shall assign at least one person, who shall be increased according to the quantity of the partial and specific projects undertaken and the degree of construction risk.

(2) If the labor subcontractor has less than 50 construction personnel, it shall be equipped with one full-time production safety administrator; If there are 50 to 200 employees, there shall be 2 full-time production safety management personnel; Where there are 200 or more persons, there shall be 3 or more full-time administrative personnel of production safety, and the increase of construction risks shall not be less than 5‰ of the total number of construction personnel according to the actual situation of the construction risks of partial and specific projects.

Article 15 For engineering projects that employ new technologies, new techniques, new materials, or projects with many harmful factors and great difficulty in construction, the number of full-time administrative personnel of production safety shall be increased according to the actual conditions of construction according to the staffing standards stipulated in Articles 13 and 14.

Article 16 Construction work teams may set up part-time safety inspectors to conduct safety supervision and inspection of their work sites.

Construction enterprises shall regularly conduct safety education and training for part-time safety inspectors.

Article 17 The issuing and administration organs of production safety licenses shall, when issuing production safety licenses, examine the establishment of the administrative organs of production safety and the staffing of full-time administrative personnel of production safety of construction enterprises.

Article 18 The competent construction departments shall, when issuing construction licenses or approving reports on the commencement of work, examine the staffing of full-time administrative personnel of production safety for the project.

Article 19 The competent construction departments shall supervise and inspect the administrative organs of safe production of construction enterprises and their full-time administrative personnel of safe production.
